Mediation and Arbitration are available to individuals when conflict arises and there is a need for a third person to provide assistance to help resolve the issues.
The mediation process is confidential, and confidentiality of the information discussed during the mediation is protected by statute. The mediator does not impose a decision for the parties, but assists the parties, in reaching their own mutually acceptable resolution. Parties who reach a mutual agreement take away with them a memorandum of agreement. These agreements are court approved, quicker than going to court, and less expensive.
In the arbitration process the arbitrator listens to any evidence either side presents, and makes a decision on the matter. The disputing parties hand over their power to decide the dispute to the arbitrator(s). Arbitration is an alternative to court action (litigation), and generally, just as final and binding (unlike mediation, negotiation and conciliation which are non-binding).
